ZTE's quad-core Era hands-on

ZTE showed up to Barcelona and Mobile World Congress with briefcases overflowing with handsets, we stopped to have a peek at its newest which features a quad-core CPU: the Era. Running the Tegra 3 quad-core processor at 1.3Ghz with an Icera i450 HSPA+ modem, 4.3-inch qHD display, an 8-megapixel camera that'll shoot 1080p video and all that stuffed into a 7.8mm-thin metallic housing. We'd already gotten our mitts on a couple other ZTE sets by the time we ran into the Era, and as far as build quality goes it's head and shoulders above the others. The feel in hand is sort of reminiscent of the Nexus One: outstanding balance and weight. The display quality is bright and crisp and in the short demo we saw, the 3D effects on the home screen are absolutely fluid. We're looking forward to this set, or at least a chance for a little more time to get acquainted.

Precious Lessons Learned From Herm?s' Unregistered Trademark ...

Love for horses, Love for gems
Although?Herm?s registered its trademark in China since 1977, it had not yet registered its Chinese name???? (?i m? sh?)?as a trademark the Legal Evening News wrote, according to Shanghai Daily, see here.

In 1995 Dafeng Garment Factory registered a trademark ??? (?i m? sh?), which is, indeed, pronounced exactly the same as the Chinese name of?Herm?s.?

In that year Herm?s filed an objection at the Trademark Review and Adjudication Board (TRAB) of the State Administration for Industry and Commerce (SAIC). However TRAB approved Dafeng Garment Factory's registration in 2001. After that?Herm?s appealed at a Chinese court.?

In 2009,?Herm?s?again appealed to the board, saying its Chinese name enjoyed a high reputation around the world and demanding the board cancel the disputed trademark. However,?Herm?s' application was rejected for a second time May 2011.

Lessons to be learned:

  • Protect your trademark name together with the Chinese version of your trademark, otherwise either the public will come up with a, possibly not so positive Chinese name, or worse a competitor will take unfair advantage of your reputation and/or will confuse the public into believing that your company is the origin of the products of your competitor.
  • Unregistered trademarks can be protected only if they are famous/well-known. That is famous in China, not in other countries, and not even in Hong Kong or Macau which are special administrative regions with their own jurisdiction.?
  • You have to proof that your trademark is famous, before the trademark dispute. Because otherwise it is hard to proof that the public knows your trademark or that of your competitor who is using an identical or similar trademark.

Unfortunately for?Herm?s, the luxury good company could not convince the court that the Chinese version of its name???? was unregistered but a famous name for some time before Dafeng Garment Factory even started using their registered trademark????. They used evidence that originated from the period after the dispute and they used evidence that showed that their trademark was famous to consumers in Hong Kong instead of the mainland.?

Spot the Difference In The Chinese version of the Herm?s Trademark And Its Clone

Top row:?

Herm?s' unregistered trademark:???? (?i m? sh? =?love horse officials = officials who love horses)

Bottom row:?

Dafeng Garment Factory registered trademark:???? (?i m? sh? = love agate officials = officials who love agate). The difference is indeed, the second character which is?? w?ng (king) +???m? (horse)=???m? (agate), a kind of gem.

Blog Archive ? Why Computer Games Are Offensive

26 Feb

Author: Arthur Ricky ?// ?Category: Games and Players

As a video game professional and a gamer I find the term ?computer games? unbelievably offensive. This doesn?t mean that I am a console fangirl simply hating on PC games, or that I refuse to develop for anything other than PC. Actually, I am referring to the use of the term by the wider community and its perpetuation of the notion that video games are for children.

My feelings on this matter were in part sparked by the debate for R18+ classification in Australia in recent years. I was following the progress closely for much of last year and was increasingly confused by the constant referral of video games as computer games. In an age where gaming exists on any and every platform one can think of, I am repeatedly puzzled by the use of such a dated term. Games have been beyond the humble home computer for decades so why are they remaining weighed down by such a term? The answer, I find, stems from those who use the term; people who oppose an R18+ classification.

Perhaps this is the primary reason for my feelings on this matter. It seems that every time I see the use of the words they are accompanied by some ridiculous spiel from a family or Christian group about how games are only for children. Or that somehow an R18+ rating system would give children access to sexual, violent or other behaviour that is beyond their maturity. This ideal is dumb, and anyone who plays video games knows this. It shows a great amount of ignorance towards the games and the industry affected by the matter. That said Australia is finally on its way to having an R18+ classification system. While I?ll admit I do scrunch up in disdain every time I see ?computer games? used in official government documentation, I?m happy that progress is being made. I know we aren?t there yet but with each step we as gamers and game professionals come closer to acceptance by the wider community. You never know maybe the groups and individuals who showed firm opposition will eventually sway to our train of thought. Can you imagine if they even became gamers themselves!

I liken the term ?computer games? instead of ?video games? to my sister?s feelings toward ?potter? instead of ?ceramicist?; it is laden with just enough ignorance toward my profession, my interests and the gaming industry as a whole that I find it infuriating enough to rant about it in an article. Unfortunately without a rating system that caters to the maturation of gamers and gaming professionals, my view is not likely to change.

Oscars Red Carpet: Emma Stone And Rooney Mara Dazzle

Our experts pick the best-dressed at the 2012 Academy Awards.

Oscar night isn't only a huge event for the world of movies; it's also a big night for fashion. Over the years, it has become known as the hottest runway show of the year, with the top designers clamoring to get their dresses on the night's nominees, hoping to win a spot on the coveted best-dressed list.

On Sunday night, all eyes were on the actresses working the red carpet, and they did not disappoint. There were pops of color on the carpet, but the big trend of the night seemed to be ladies in white. Gwyneth Paltrow looked glamorous in a white one-shoulder Tom Ford gown with a matching wrap.

MTV Style picks their best-dressed at the Oscars.

"From what I saw walking down the carpet, Gwyneth Paltrow looked amazing in Tom Ford," Janell Snowden of VH1 told MTV News. "She was in the color of the night, which was white."

Rooney Mara, a Best Actress nominee for "The Girl With the Dragon Tattoo," traded in her typical black garb for elegant white, wearing a lace Givenchy gown with a plunging back.

"I did think a lot about what I was going to wear; it's a long process," Mara told MTV News. "I like to wear white also. I wanted to mix it up. This just happened to be the most beautiful dress, that's why I wore it."

MTV Style expert Mary H.K. Choi agreed that Mara wowed in her Oscar ensemble. "White was a huge trend on the red carpet tonight, and this stark, architectural Givenchy looked absolutely surreal against the phosphorescence of her alabaster skin," Choi said. "She looked just pristine, and the fact that her impossibly shiny, jet-black hair was in a tight bun with blunt bangs really anchored the look. She dresses with a certain severity, given her young age, but I'm a huge fan."

Of course, it wasn't just the ladies in white who stole the show. "The Help" star Emma Stone turned heads in a stunning red Giambattista Valli gown.

"I just loved this dress. There were titterings on Twitter about how people either loved or hated the bow, but I thought a dramatic, festive accent at the neckline looked stunning and complemented the side sweep of her red hair," Choi said. "A risk, definitely, but I think it absolutely paid off."

Stone's co-star Jessica Chastain also made a lasting impression on her first Oscar red carpet. Chastain, who was nominated for Best Supporting Actress, shined on the carpet in a black and gold Alexander McQueen gown.

"This is a big moment — probably it's the biggest moment of my life — so I needed a dress that was a big-moment dress," Chastain told MTV News. "It's McQueen, and the embroidery and the way it fits — to me, this dress is how I'm feeling right now."

Peak Oil to increase investment in green energy sector

Last Updated : 24 February 2012 at 21:05 IST Source :pr news wire

NEW YORK (Commodity Online): Peak oil, the end of the line for oil extraction, has increased investments in the green energy sectors to the extent of 30% at $211 billion, according to Danny Esposito, co-editor for financial newsletter and web site Penny Stock Detectives.

China, the U.S., and Germany are countries that are leading the way in green energy. These countries are increasing the number of research and development facilities, while building out massive projects in order to secure green energy for the future.

U.S. and Germany are struggling to produce efficient systems at low cost, which is placing a strain on investment in this green energy within these countries to implement the solar panels to produce energy.

Meanwhile, studies are showing that wind turbines and biomass could produce more energy than solar, and are cheaper alternatives. It?s possible that both these countries might focus more on these areas and less on solar energy.

?There is no question that peak oil is driving countries to invest in green energy. Green energy investments will just continue to rise in spite of what the economy is doing. If you want a recession-proof investment that is critical to our future, the green energy space is one to consider seriously.? said Esposito.

Meanwhile, India has also taken initiatives to introduce more and more green energy projects under different programmes to increase the share green energy in India's energy sector.

Scientists create potent molecules aimed at treating muscular dystrophy

ScienceDaily (Feb. 22, 2012) ? While RNA is an appealing drug target, small molecules that can actually affect its function have rarely been found. But now scientists from the Florida campus of The Scripps Research Institute have for the first time designed a series of small molecules that act against an RNA defect directly responsible for the most common form of adult-onset muscular dystrophy.

In two related studies published recently in online-before-print editions of Journal of the American Chemical Society and ACS Chemical Biology, the scientists show that these novel compounds significantly improve a number of biological defects associated with myotonic dystrophy type 1 in both cell culture and animal models.

"Our compounds attack the root cause of the disease and they improve defects in animal models," said Scripps Research Associate Professor Matthew Disney, PhD. "This represents a significant advance in rational design of compounds targeting RNA. The work not only opens up potential therapies for this type of muscular dystrophy, but also paves the way for RNA-targeted therapeutics in general."

Myotonic dystrophy type 1 involves a type of RNA defect known as a "triplet repeat," a series of three nucleotides repeated more times than normal in an individual's genetic code. In this case, the repetition of the cytosine-uracil-guanine (CUG) in RNA sequence leads to disease by binding to a particular protein, MBNL1, rendering it inactive. This results in a number of protein splicing abnormalities. Symptoms of this variable disease can include wasting of the muscles and other muscle problems, cataracts, heart defects, and hormone changes.

To find compounds that acted against the problematic RNA in the disease, Disney and his colleagues used information contained in an RNA motif-small molecule database that the group has been developing. By querying the database against the secondary structure of the triplet repeat that causes myotonic dystrophy type 1, a lead compound targeting this RNA was quickly identified. The lead compounds were then custom-assembled to target the expanded repeat or further optimized using computational chemistry. In animal models, one of these compounds improved protein-splicing defects by more than 40 percent.

"There are limitless RNA targets involved in disease; the question is how to find small molecules that bind to them," Disney said. "We've answered that question by rationally designing these compounds that target this RNA. There's no reason that other bioactive small molecules targeting other RNAs couldn't be developed using a similar approach."

Jack Welch: 'I don't feel undertaxed' (Politico)

Call him the anti-Buffett.

Former General Electric CEO Jack Welch said Wednesday that he doesn?t feel undertaxed.

?I pay over 30 percent every year,? said Welch on CBS?s ?This Morning.? ?I don?t feel undertaxed in any way at all.?

It was clear that Welch would not be following the model of billionaire Warren Buffett?s friendly relations with the president.

Buffett became the inspiration behind the ?Buffett rule,? which suggests that millionaires and billionaires should pay at least the same rate as middle-class wage earners, after he pointed out his secretary paid a higher effective tax rate than he did.

Although his self-reported tax rate of over 30 percent indicates that Welch might be close to adhering to the rule ? the highest tax bracket is 35 percent ? the businessman offered no Buffett-esque support for the president.

?I will support any Republican nominee against the current incumbent,? he said, when asked if he could support Santorum if the former Pennsylvania won Michigan and the nomination.

Pushed by host Charlie Rose to say whether he?d be prepared to pay more taxes if they could be sure where the money was going, Welch was dismissive.

?If we thought it would go to deficit reduction and not more silly programs, maybe that would be a good argument,? said the wealthy businessman.

But with that said, Welch wasn?t completely critical of President Barack Obama, saying the president?s plan to reduce the corporate tax rate was a step in the right direction.

?We?re going to have dueling tax proposals. As long as they go in this direction, it?s all good. But there won?t be anything done this year,? said Welch.

And Welch also had good things to say about the president?s foreign policy. ?I think the president has done a reasonable job in foreign policy. In my opinion, it?s been one of his strongest areas,? he said.

(AP) ? The U.S. apologized Tuesday for the burning of Muslim holy books that had been pulled from the shelves of a detention center library adjoining a major base in eastern Afghanistan because they contained extremist messages or inscriptions.

The White House echoed military officials in saying that the burning of Qurans and other Islamic reading material that had been tossed in a pile of garbage was an accident.

But more than 2,000 Afghans protested the incident outside the Bagram Air Base that stoked rising anti-foreign sentiment and fueled Afghan claims that foreign troops disrespect their culture and Islamic religion even as the Americans and other NATO forces prepare to withdraw by the end of 2014.

Demonstrators who gathered outside Bagram Air Field, one of the largest U.S. bases in Afghanistan, shouted, "Die, die, foreigners!" Some fired rifles into the air. Others threw rocks at the gate of the base and set tires on fire.

U.S. Gen. John Allen, the top commander of American and NATO forces in Afghanistan, said the books had been mistakenly given to troops to be burned at a garbage pit at Bagram, a sprawling U.S. military base north of the Afghan capital, Kabul.

"It was not a decision that was made because they were religious materials," Allen said. "It was not a decision that was made with respect to the faith of Islam. It was a mistake. It was an error. The moment we found out about it we immediately stopped and we intervened."

The Quran is the most sacred object in the daily lives of Muslims and burning it is considered an offense against God. The Quran is so important in the faith that Islamic teaching spells out how it should be handled, including directing anyone who touches it to be in a state of ritual purity. Muslims can only dispose of Qurans in very specific ways, including burning or burying those that have been damaged or corrupted to prevent God's word from being defiled.

A Western military official with knowledge of the incident said it appeared that the Qurans and other Islamic readings in the library were being used to fuel extremism, and that detainees at Parwan Detention Facility, which adjoins Bagram, were writing on the documents to exchange extremist messages. He spoke on condition of anonymity because he was not authorized to release the information.

The military official said that several hundred Islamic publications, including Qurans, were removed from the library. Some of the publications had extremist content; others had extremist messages written on their pages by detainees, the official said. The official said the documents were charred and burnt, but none of them were destroyed.

"We will look into the reason those materials were gathered," Allen said. "We will look into the manner in which the decision was made to dispose of them in this manner."

Allen issued a new directive ordering all coalition forces in Afghanistan to complete training in the proper handling of religious materials no later than March 3. The training will include the identification of religious materials, their significance, correct handling and storage, he said.

The White House also apologized, with press secretary Jay Carney saying it was a "deeply unfortunate incident" that doesn't reflect the respect the U.S. military has for the religious practices of the Afghan people. Carney did not address details about what occurred.

U.S. Defense Secretary Leon Panetta added his voice, saying he disapproved of the conduct. He promised to review the results of the coalition's investigation to ensure that all steps are taken to prevent it from happening again.

In a statement, Afghan President Hamid Karzai condemned the incident and appointed a delegation to investigate. He said initial reports were that four Qurans were burned.

Early Tuesday, as word of the incident spread, about 100 demonstrators gathered outside the base in Parwan province. As the crowd grew, so did the outrage.

One protester, Mohammad Hakim, said if U.S. forces can't bring peace to Afghanistan, they should go home.

"They should leave Afghanistan rather than disrespecting our religion, our faith," Hakim said. "They have to leave and if next time they disrespect our religion, we will defend our holy Quran, religion and faith until the last drop of blood has left in our body."

Ahmad Zaki Zahed, chief of the provincial council, said U.S. military officials took him to a burn pit on the base where 60 to 70 books, including Qurans, were recovered. The books were used by detainees once incarcerated at the base, he said.

"Some were all burned. Some were half-burned," Zahed said, adding that he did not know exactly how many Qurans had been burned.

Zahed said five Afghans working at the pit told him that the religious books were in the garbage that two soldiers with the U.S.-led coalition transported to the pit in a truck Monday night. When they realized the books were in the trash, the laborers quickly worked to recover them, he said.

"The laborers there showed me how their fingers were burned when they took the books out of the fire," he said.

Afghan Army Gen. Abdul Jalil Rahimi, the commander of a military coordination office in the province, said he and other officials met with protesters, tribal elders and clerics to try to calm their emotional response. "The protesters were very angry and didn't want to end their protest," he said.

Later, however, the protesters ended the rally and said they would send 20 representatives from the group to Kabul to talk with Afghan parliamentarians and demanded a meeting with Karzai, Rahimi said.

The governor's office in Kandahar province in southern Afghanistan called the incident a "shameful move by some stupid individuals."

Zia Ul Rahman, deputy provincial police chief, said between 2,000 and 2,500 protesters demonstrated at the base.

"The people are very angry. The mood is very negative," Rahman said while the rally was going on. "Some are firing hunting guns in the air, but there have been no casualties."

Police said a similar protest on Tuesday just east of Kabul ended peacefully.

In April 2011, Afghans protesting the burning of a Quran by a Florida pastor turned deadly when gunmen in the crowd stormed a U.N. compound in the northern city of Mazar-e-Sharif and killed three staffers and four Nepalese guards.

Also on Tuesday, NATO said four NATO service members were killed in southern Afghanistan ? three in a roadside bombing and one in a non-battle related injury. The international military coalition did not give any other details about their deaths. So far this year, 47 NATO service members have been killed in Afghanistan.

Review car insurance: What Increases Auto Insurance Costs ...

Monday, February 20th, 2012 at ?

elizabeth smart : What would increase the auto insurance costs?

Response: Eliazbeth, I think this is a smart way of looking at things. Most people are asking I want low auto insurance rates, cheap car insurance- when they are doing everthing on the road which increases their auto insurance rates. It is always good to approach things from all angles to get optiium results. Like stop doing things which increase the rates, and start doing thigns which would lower the rate. Yes, we will discuss the other approach of doing things to get low auto insurance rates- but let me tell you that what brings 80% results of cheap car insurance or lower auto isnurance is :

Compare auto insruance quote. Yes, you need to do this one thing over and over again to get optimum results again and again at each renewal and mid-term.

Review car insurance : What increases auto insurance costs.

Lets see the details of what can increase your auto insurance costs.

Driving today can cost a lot, but there are some actions that will increase auto insurance costs. Getting the best deal on any insurance policy is important and you may invest plenty of time and effort to find that deal. You need to know what might end up costing you more money and making all of that effort pointless.

1. Filing claims ? the more claims you have on your insurance policy then the higher your?liability becomes. Insurance companies will adjust your premium costs to cover that added liability or they may end up just dropping you from coverage entirely. Keep in mind that a number of claims may also make it difficult to find new coverage.

2. Driving more - the number of miles that you put on your vehicle each year will have an effect on the amount you pay for your insurance. Companies know that the longer you are behind the wheel then the greater your chances for being involved in an accident.

3. Dropping other insurance policies with the company that holds your auto insurance ? most companies offer a discount for having multiple policies through the same company. If you choose to change one policy then it can have an effect on any other policies that the company still maintains.

4. Moving to a new location - where you live can have one of the biggest impacts on your auto insurance costs. You may be able to offset the rise in a premium by investing in new security for your vehicle or finding a secured location to park the vehicle when it is not being driven. You will also need to be aware of the weather pattern in the new location. A bad weather history can mean higher potential costs for insuring your vehicle in your new community.

5. Changing jobs - some professions are just considered more risky than others.?Insurance companies?view your job or employment as an indicator of what type of driver you are likely to be. The more dangerous the job and the more of an adrenaline rush it causes then the more the insurance company suspects you will be an adrenaline driver.

6. Getting a new car ? the newer the vehicle then the more it will likely cost to insure that vehicle. Choose a car that has more safety features and that ranks well on safety tests if you want to balance the higher cost of a premium for a newer car with the discounts the safety will afford.

7. Traffic violations - how you drive will determine how the insurance company will cover the driving that you are going to be doing. Moving violations (like speeding or driving distracted) can inflate the expense of insurance. Put your cellphone away when you are behind the wheel so that you are not even tempted to talk. Keep your eyes on the road and your mind on your driving. Keep your foot light on the gas pedal. Stay focused on the job at hand and you will be more likely to avoid getting a ticket that will cost in a fine and in the higher insurance premium that will come with it.

8. Late payments - paying your bills late will end up hurting your credit rating. Insurance companies have started looking at credit ratings to determine the reliability of potential policy holders and will review those ratings with existing policies. A lower credit rating will usually translate into a higher premium.

Little changes can add up to big expenses when it comes to auto insurance. Companies look at everything from your credit history to your driving history to see what risk you will be on the road. Be aware of the actions that will increase your auto insurance to be sure that you keep the best premium rate possible.

So stop doing this. and compare auto insruance quotes today to get your low auto insurance rates.

A Look at Long Distance Relationships

Long distance relationships can definitely be rather tricky for people of all ages. These kinds of relationships are quite common nowadays as the Internet brings people together from all over the world. And there are also people tha have to endure long distance relationships because of job obligations that take them away from their loved ones for extended periods of time.

A relationship with someone that lives far away is just as special as any other relationship. However, they come with some extra baggage since each partner is far away. The traditional definition of a long distance relationship mostly takes the form of an intimate relationship in which the partners are separated over long distances.

These relationships are quite possibly one of the hardest things to tackle. They can even begin when someone goes off to college. As a result they are becoming somewhat popular among students at different college campuses for a variety of reasons.

There are actually a lot of people that will leave behind a special someone when they attend college away from home.

At such a young age it is probably even more difficult. Long distance relationships are difficult and can be very stressful, so don?t be shocked if you end up having a few fights or doubts about your relationship. If both of you are serious about maintaining the relationship and are both truly in love, things will work out for you no matter how long you have to stay apart.

Although they can be very cold, lonely, and cause some pain, they can still end up working. In the end, it really all depends on the couple involved.

Baron family testifies at inquest | FlamboroughReview.com

By Catherine O?Hara, REVIEW STAFF

?We screwed up, we screwed up.?

Those are the words Jesse Baron woke up to at his Waterdown home on June 6, 2010. His younger brother Kyle, 18 at the time, had just discovered his friend?s lifeless body on the living room floor.

The friend was Christopher Skinner, a bright student and talented musician who during the evening of June 5 and early morning hours of June 6 consumed a deadly amount of alcohol at two parties.

In his testimony during a coroner?s inquest into the 17-year-old Flamborough boy?s death, Jesse explained that drinking ? sometimes in excess ? took place on several occasion at his home. On the night of Skinner?s death, his parents were home.

The Waterdown household has been described as ?a party house,? something both Baron boys confirmed was an accurate representation.

On at least three occasions, teens had passed out from binge drinking at the home. During those times, a hazing game was played that included partygoers drawing on the intoxicated youths with markers. Skinner, too, was submitted to such treatment; he also had his ankles bound with duct tape and CDs stacked on his head.

The Baron boys say it was all in good fun, a prank that instigated a few good laughs. But when asked by the Coroner?s Crown Karen Shea if they thought this to be funny today, both said no.

While Jesse, 21, has since cut down on his drinking following Skinner?s death, the tragic loss of a young life full of potential hasn?t impacted Kyle.

?It didn?t really change the way I act,? said Kyle. ?We all still party, we still drink.?

The five-person jury selected to pen recommendations to prevent similar deaths wondered if liquor licence act reforms could help curb binge drinking among youth.

Kyle said that, while parents would probably be more cautious when it came to hosting parties where underage drinking is taking place, he said teens will continue to drink if they chose.

Increased fines, between $500 and $1,000, were proposed at Thursday?s inquest. But Kyle suggested that teens who are slapped with such a fine would be unable to pay it. The penalty would ultimately affect parents? pocketbooks.

Dr. Jack Stanborough is presiding over the inquest, which resumes this afternoon with testimony from other Baron family members.

Pre-Tax vs After Tax Retirement Investments: 401K vs Roth IRA

In recent years, Roth IRAs have become very popular with investors. The Roth IRA is named after Senator William Roth of Delaware, who sponsored the 1997 legislation that created them. The basic idea behind the Roth IRA is pretty simple ? you invest after-tax money into your Roth IRA, and are not taxed on the money when you withdraw it. Conversely, with a 401(k) (or a traditional IRA), you invest pre-tax money, but pay taxes on everything when you withdraw. I?ll compare and contrast the Roth with a 401(k), since that?s what I?m most familiar with.

Investing in a Roth IRA means you will pay less in taxes.

As long as your investments yield a positive return, this will always be true because you?re only taxed on the principal with a Roth (since it?s after-tax money, you?ve already paid the tax before investing it) whereas you?re taxed on withdrawals of principal and earnings when you withdraw from a 401(k). Thus, many financial advisors tout this as a reason for the Roth account being superior to the 401(k).

However, I think that this is an example of asking the wrong question. What?s most important is not to minimize taxes, but rather, it?s to maximize the amount of money you keep.

Deciding Between Pre-Tax or After Tax Money For Your Retirement Accounts

How do we make a decision between these two funding options for your retirement needs IF you?re financially limited to one option? Let?s analyze a basic scenario to see what considerations to take when deciding how to invest for retirement. Let?s start with these assumptions:

  • One has $5,000 of pre-tax money to invest.
  • Investments will double between now and retirement.
  • The current tax rate and post-retirement tax rate are both 28%.

Given these assumptions, let?s work with some examples.

Amy decides to invest in a Roth IRA. The pre-tax amount of $5,000 is taxed during the normal course of events. She pays $1,400 in taxes (28% of $5,000), leaving her with $3,600 to invest. Her investment doubles by the time of retirement, leaving her with $7,200.

Beth opts for a 401(k) account. The entire $5,000 is invested into her account ? she does not pay any taxes at the current time. Her $5,000 also doubles, leaving her with an account balance of $10,000. When she makes withdrawals, they are taxed at 28%. She pays $2,800 in taxes, leaving her with $7,200 in her pocket.

While Amy pays only $1,400 in taxes and Beth pays $2,800, it?s important to note that Amy is paying in current dollars and Beth is paying in future dollars (which are almost certain to be worth less than current dollars).

There?s no accounting trick needed to make the numbers come out this way. By taking the tax hit up front, you start with less money in the balance of your Roth than in an equivalent 401(k). As an aside, note that if you decide on a starting investment of $5,000 in a Roth IRA, then you?ll need a pre-tax income of $6,944.45.

Is there nothing certain but taxes? The key variable is the tax rate. If you pay a lower tax rate today than you will at retirement, then a Roth makes sense. If you expect to pay a lower rate after retirement, then a 401(k) is the right choice. Sounds very easy ? but there?s no way to guarantee future tax rates.

The Vote For A Roth IRA

When you?re currently in a lower tax rate than you expect in the future, then your best choice is a Roth IRA. Here are some scenarios where a Roth makes sense.

  • Crystal just graduated college and landed her first real job. She?s on the lowest rung of the corporate ladder, and her income will be in the 10% bracket. Barring some unforeseen changes in the tax law, Crystal will never again pay such a low tax rate. It makes sense to invest in a Roth, as it means paying taxes at the 10% rate instead of a higher future rate.
  • Susan lost her job in March and has been on unemployment all year, dropping her income lower than it has been in decades. The silver lining is that she can invest in a Roth IRA and pay a low tax rate on those contributions.
  • Emily expects to have substantial post-retirement income. She split her career between two companies and will receive a generous pension from both. She also has 401(k) accounts through each of the employers, and the investments have performed very well. The net effect is that Emily?s post-retirement income will be substantially higher than her current income ? putting her in a higher tax bracket. It makes sense to take advantage of her lower current rate and invest in a Roth IRA.

What are some issues that can impact your decision to go with a Roth? What about this question: will a balanced budget amendment affect tax rates?

Let?s consider the larger picture here as well, and bring up some potential events down the road. You may have heard that some politicians have been pushing a balanced budget amendment which would force congress to match spending to revenue. The two basic ways to balance the budget would be to cut spending and raise taxes. However, the proponents of the balanced budget amendment seem to be glossing over the difficulties in passing such an amendment. One of the requirements for this is ratification by the state legislatures of ? (three quarters) of the states. When you consider that one of the easiest ways to cut spending would be to push the cost of certain programs down to the states, then it seems likely that at least 13 states would opt to block ratification.

When Does A 401(k) Make Sense?

When you expect your current tax rate to exceed your post-retirement tax rate, then a 401(k) is a better option. Here are some scenarios that support the choice for a 401(k) account.

  • As a result of winning $100,000 in the lottery this year, Jane has a modified adjusted gross income (MAGI) of $175,000. Since Roth IRA contributions are not allowed for individuals with an MAGI over $110,000 or married couples with an MAGI over $160,000, Jane is not allowed to contribute to a Roth IRA, but is allowed to contribute to a 401(k).
  • Gina is in the last year of an exemplary career and she?s in line to make a lot of money this year. A promotion five years ago resulted in a big raise. She?s also receiving a substantial performance bonus for landing several key customers during the year. While her income is still below the limits for a Roth IRA contribution, it will still be twice what her projected post-retirement income will be. This means that Gina should opt to contribute to a 401(k), since a Roth IRA contribution would be taxed at a higher rate.
  • Heidi has been investing in a Roth IRA since her first job. She doesn?t have substantial assets outside of her account. Since withdrawals from her Roth IRA won?t count as income, her post-retirement income is projected to be just a few thousand dollars. It makes sense for her to reduce her current income and push more income into her post-retirement years so that it is taxed at the lowest rate. Thus, she decides to fund a 401(k) in lieu of investing in her existing Roth. Note though, that she shouldn?t completely minimize her post-retirement income; she may want to earn enough income to reach the top of at least the second tax bracket (possibly higher, depending on what her current bracket is).

General Thoughts & Basic Assumptions

Here are additional tips to support your retirement investing decisions.

  • The above scenarios all assume that the investor only has enough money to contribute to either a 401(k) or Roth IRA, but not both. If you?re able to do it, it may make sense to max out both. As of the year 2012, you are limited to contributing $5,000 to a Roth, with a $1,000 ?catch-up? provision that allows people 50 or older to contribute a total of $6,000. You are limited to contributing $17,000 to a 401(k), with a catch-up provision of $5,500 that allows people 50 or older to contribute a total of $22,500 per year. Thus, even if a Roth is the best option for you, it may make sense to contribute to a 401(k) after you?ve maxed out your Roth IRA. Some employers offer a Roth 401(k), which, at a high level, is a Roth IRA with the higher limits of a 401(k).
  • In general, a Roth makes the most sense early in your career, since your income in these early years will likely be less than your post-retirement income. With every raise or increase in your income, the scale will tip a bit more in favor of the 401(k), until the point where your current tax rate exceeds your projected post-retirement rate. Don?t feel that you must pick one plan and stick to it. It might make sense to invest in a Roth at age 25 but a 401(k) at age 50. This doesn?t mean that your original decision was wrong ? it was actually the best investment choice for that particular time period or circumstance.
  • Don?t ignore the yield of the actual investment when making your choice. If a 401(k) is your optimal strategy, but your specific 401(k) plan offers weak investments compared to your choices in a Roth IRA, then a Roth might be the preferred option. Earning 10% and paying slightly higher taxes is still better than earning 1% and paying lower taxes.
  • While it?s impossible to predict future tax rates, it?s important to realize that the brackets are periodically adjusted for inflation. For example, while the lowest tax bracket currently cuts off at $8,500 for single people, thirty years from now, the bracket might cut off at $20,000. So if you?re earning $100,000 now and expect to earn $100,000 when you retire, don?t assume that you?ll always be in the same bracket.
  • Take advantage of employer matching. My employer matches 401(k) contributions dollar for dollar up to a certain amount. This means that I double my money right away. Even if a Roth account is generally a better option for me, it makes sense to take advantage of the matched funds.
  • While the focus of this article has been on maximizing your nest egg, there are other reasons why you may opt for either a Roth IRA or a 401(k) plan. For example, you can withdraw the principal from a Roth account at any time without penalty (remember, you?ve already paid taxes on this money). These factors may play a part in your decision.
  • Everyone?s situation is unique. If you have post-retirement income from other sources (such as a pension or non-retirement investment accounts), then this will affect your post-retirement tax rate. As with any financial decision, the more information you use, the better the decision will be.

Science of Speed Dating Helps Singles Find Love

Image: Nino Mascardi/Getty Images

As a psychologist, I have always found the concept of speed dating fascinating. During a series of mini dates, each spanning no more than a couple of minutes, participants in a speed-dating event evaluate a succession of eligible singles. They make split-second decisions on matters of the heart, creating a pool of information on one of the more ineffable yet vital questions of our time?how we select our mates.

The concept of rapid-fire dating has gained tremendous popularity, spreading to cities all over the world. One speed-dating company in New York City, for example, holds a gathering almost every day. Last year online coupon company Groupon hosted the world?s largest speed-dating event, with 414 attendees crammed into a restaurant in Chicago. Start-up companies now meet with investors, pregnant couples interact with doulas, and homeless dogs court potential owners, all using the speed-dating format.

Some years ago I caved to my curiosity and tried it out myself. As it turns out, I like to talk?a lot. When the little buzzer went off after three minutes, I often found myself still trying to explain to my bedazzled dating partner why my last name has four syllables (it is Dutch). As you might imagine, I did not find the love of my life.

I made some beginner?s mistakes; however, I am not alone in having struggled with speed dating. Even if meet-and-greet matching events might seem like the most efficient way to comb through many options at once, a wealth of data reveals that the context in which we make a choice weighs heavily on the outcome. Speed-dating events can promote a particular decision-making style that might not always work in our favor. Yet we need not be passive victims of our circumstances. Knowing how your environment influences your mind-set, a quality known as ecological rationality, can help you make the choices that are best for you.

Decisions, Decisions
Traditional dating can seem haphazard, contingent on seemingly minor details such as whether you signed up for the right yoga class or patronized the same bar as your future love interest. Online dating, too, has its drawbacks, requiring hours to sift through profiles and craft careful introductory e-mails before arranging to meet in person. Speed dating, by comparison, offers the opportunity to chat up many eligible singles in rapid succession.

In a typical speed-dating event, participants pair off at individual tables and chairs for a few minutes of conversation. When the buzzer sounds, half of the singles move to another chair and a different partner, in a kind of round robin. After the event is over, the daters submit to the event?s organizers the names of the individuals they would like to see again. It sounds simple, but each variable in the design of the event can affect the daters? outcomes.

In spite of maxims about so many fish in the sea, for example, recent research tells us that the heart prefers a smaller pond. In a study in 2011 in the journal Biology Letters, University of Edinburgh psychologist Alison P. Lenton and University of Essex economist Marco Francesconi analyzed more than 3,700 dating decisions across 84 speed-dating events. The authors found that when the available prospects varied more in attributes such as age, height, occupation and educational background, people made fewer dating proposals. This effect was particularly strong when individuals were faced with a large number of partners. Additionally, in speed-dating events where the characteristics of the daters varied much more, most participants did not follow up with any of their matches.

Results observed in the world of online dating support this finding. A study in 2008 by Lenton and Barbara Fasolo of the London School of Economics and Political Science indicates that participants often misjudge how the number of options available to them will affect their feelings. Participants presented with a broad array of potential partners more closely aligned with their anticipated ideal did not experience greater emotional satisfaction than when presented with fewer options.

Many in NY cheer delay of animal disease lab move (AP)

GARDEN CITY, N.Y. ? The Obama administration has put the brakes on a plan to build a new lab that studies contagious animal diseases, a decision that has pitted disappointed Kansans hopeful about growth against New Yorkers fighting to keep about 200 jobs at a Cold War-era facility on a tiny island.

Proponents say the new lab, estimated to cost $650 million, is needed to protect the nation's livestock industry, while skeptics argue that such an investment in an economic crisis is unwise.

"The prospect of taking a wrecking ball to a multimillion-dollar Homeland Security investment in the study of foot-and-mouth disease at Plum Island to accommodate another several hundred million-dollar research lab right in the middle of cattle country has always seemed like the height of irresponsible government spending," said Bob DeLuca, president of the Group for the East End, which focuses on environmental issues on eastern Long Island.

Adrienne Esposito, executive director of the New York-based Citizens Campaign for the Environment, gushed when told this week that President Barack Obama recommended no additional funding for construction of a new biosecurity lab. Obama also directed the U.S. Department of Homeland Security to reassess the viability of the National Bio- and Agro-defense Facility planned near Kansas State University.

"If nothing is broken, why are they trying to fix it?" Esposito asked of the Plum Island laboratory, which sits on an 840-acre, pork chop-shaped island about 100 miles east of New York City. "I think even the president realized it would be a big mistake to move. This is nothing but a boondoggle, a money grab that the president has stopped."

Homeland Security Secretary Janet Napolitano told a House appropriations subcommittee on Wednesday that the lab remains necessary and that Obama's budget request for the next fiscal year includes $8 million for research in Kansas. She predicted the project will move forward if Congress provides the funding.

"We've had trouble with getting the money for the NBAF for the last three years," she said in response to committee Chairman Robert Aderholt's question about whether Homeland Security is committed to a lab on the mainland. "It has been peer-reviewed and put in Kansas, near a lot of other resources. That makes sense to put it there."

Kansas Sen. Pat Roberts said the state's delegation has been "working overtime, across party lines" on the lab project with federal agencies. Spokeswoman Sarah Little said Roberts remained focused on shepherding the lab through the appropriations process, calling it a "critical national security priority."

On the other side of the country ? and the political aisle ? Democratic Rep. Timothy Bishop, whose eastern Long Island district includes Plum Island, countered that Republicans would ordinarily be pleased that the president was halting potentially wasteful spending.

"In the fiscally constrained environment that we are in, I don't think there is the need to spend upward of $1 billion on a new facility when there is a perfectly good one, doing perfectly good work already here," he said.

Homeland Security, which took control of operations at Plum Island after the federal agency was formed in the wake of the Sept. 11 attacks, has spent $35 million on improvements at the lab in recent years, including an expansion of large-animal research rooms, renovation and expansion of the necropsy facilities, and infrastructure and security upgrades.

The department has argued that a modernized lab in Kansas that could study diseases affecting both animals and humans is needed and that the Cold War-era Plum Island center, which studies only animal diseases, is approaching the end of its usefulness. Officials in New York point to the recent upgrades ? and the fact that dangerous human diseases are already being studied at places like the Centers for Disease Control and Prevention in Atlanta ? as arguments opposing a new facility.

Dr. Ron DeHaven, vice president of the American Veterinarian Medical Association and former administrator of an Agriculture Department agency that performs research at Plum Island, said the improvements on Plum Island in recent years were intended as a stop-gap measure until a new facility was built.

"Five years ago, there was no doubt in anyone's mind that the facility at Plum Island was outdated," he said. "From the get-go that money was intended to be a temporary fix; there was never an expectation the improvements would do anything more than be a bridge to a new facility."

Recruiting scientists to work at the remote island ? which played a role as the ruse to get fictional serial killer Hannibal Lecter to cooperate with FBI trainee Clarice Starling in "The Silence of the Lambs" ? has been a problem, DeHaven said.

"When you mix the high cost of living and the remoteness or where it is, we had problems with recruiting the best scientists," he said. Like others, he said concerns about contamination leaks at a new facility are overblown. "Bio-containment has improved greatly," he said, pointing to the CDC in Atlanta.

He said a new facility is needed somewhere, despite the cost of $650 million or more. "An outbreak of foot-and-mouth would impact our economy by that much in the first six hours," he said.

Besides the Homeland Security review, the National Academy of Science is amid a second review of the proposed Kansas site, focusing on concerns that the nation's heartland may not be a suitable location to study infectious animal diseases because of its proximity to so many cattle farms. When it was opened in the 1950s, the federal government chose Plum Island ? the site of a former Army fort ? because it was off the mainland.

In an earlier study, the academy identified a 70 percent chance that a release of foot-and-mouth disease could occur at the new lab during its projected 50-year lifespan. Damage to the livestock industry could total as much as $50 billion, officials have said.

Foot-and-mouth virus is so contagious it has been confined only to the Plum Island lab, where accidents have already happened.

The Bush administration acknowledged in 2008 that a release of the virus into cattle holding pens on Plum Island in 1978 triggered new safety procedures. The release was one of about a half-dozen accidents that have occurred at the lab, but the only one in which pathogens escaped into the atmosphere; the others were all confined. There was no known environmental impact, and there are no cattle farms on eastern Long Island.

The AP has previously reported that a simulated outbreak of the disease in 2002 ? part of a government exercise called "Crimson Sky" ? ended with fictional riots after the simulation's National Guardsmen were ordered to kill tens of millions of farm animals, so many that troops ran out of bullets.

In the exercise, the government said it would have been forced to dig a ditch in Kansas 25 miles long to bury carcasses. In the simulation, protests broke out in some cities amid food shortages.

The General Services Administration, which is charged with selling the island to defray the costs of building the Kansas lab, has repeatedly delayed its release of a draft environmental impact statement originally promised in summer 2010 and most recently expected at the end of January. No sale can take place until an environmental review and public hearings are held.

An administration spokesman did not respond to inquiries Tuesday to explain the latest delay.
